This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
REQUEST FOR RELEASE OF FUNDS
On or about September 19th, 2022, the Dickenson County Board of Supervisors will submit a request to the Virginia Department of Housing and Community Development (DHCD) for the release of Appalachian Regional Commission (ARC) Area Development (Construction) 2021 funds as amended underneath the Appalachian Regional Development Act of 1965 to undertake a project known as Red Onion Industrial Park Project for the purpose of providing new development space for industrial operations with the intent of creating new jobs for the residents of Dickenson County and the surrounding area. Project activities include the construction/installation of utility lines leading to the proposed Industrial Park site, construction of building pads for future park residents, and partial remediation of an Abandoned Mine Land (AML) highwall adjacent to the site.
FINDING OF NO SIGNIFICANT IMPACT
The Dickenson County Board of Supervisors has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the office of the Dickenson County Board of Supervisors (818 Happy Valley Drive, Clintwood VA 24228 between 8:30 AM and 4:30 PM) and at the office of the Cumberland Plateau Planning District Commission (224 Clydesway Drive, Lebanon VA 24266 between 8:00 AM and 4:00 PM and may be examined or copied on weekdays at the times listed with the corresponding addresses above.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Dickenson County Board of Supervisors – PO Box 1098, 818 Happy Valley Drive, Clintwood, VA 24228. All comments received by September 16, 2022 will be considered by the Dickenson County Board of Supervisors prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
Dickenson County certifies to DHCD that Larry Barton in his capacity as County Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DHCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Dickenson County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
DHCD will consider objections to its release of funds and the Dickenson County certification received by October 20th, 2022 or a period of thirty days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Dickenson County approved by DHCD; (b) the Dickenson County has omitted a step or failed to make a decision or finding required by NEPA regulations at 40 CFR Parts 1500-1508; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized before approval of a release of funds by DHCD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures and shall be addressed to DHCD at:
